terms of service
effective august 8, 2026These Terms of Service ("Terms") govern your access to and use of the DayOne website (dayone.fans) and the DayOne / Day 1's mobile application (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the age of digital consent where you live) to use the Service, and at least 18 to make purchases or connect a social account. If you use the Service on behalf of an organization, you represent that you're authorized to accept these Terms for it.
2. The Service
DayOne connects fans with creators, artists, and performers. Fans can join a creator's line, attend events, submit content, and purchase features such as line cuts and cosigns/shoutouts. Creators can build a community, recognize their "Day 1" fans, connect social accounts, and use automated tools ("agents") to post or repost fan‑submitted content to their own connected accounts.
3. Accounts
You're responsible for your account and for keeping your credentials secure. Provide accurate information and keep it current. You're responsible for activity that occurs under your account.
4. Creators, connected accounts & automated posting
If you connect an Instagram or TikTok account, you authorize DayOne to access that account and to publish or repost content to it on your behalf as you configure or approve, including via automated agents that post fan‑submitted content. You are responsible for the content posted to your accounts and for complying with each platform's terms and policies. You can revoke this authorization at any time by disconnecting the account in the app or in the platform's settings. DayOne is not responsible for platform decisions (e.g., content removal, rate limits, or account actions).
5. User content & license
You retain ownership of content you submit. By submitting content, you grant DayOne and the relevant creators a worldwide, non‑exclusive, royalty‑free license to host, display, reproduce, adapt, and distribute that content to operate and promote the Service — including allowing a creator (and their DayOne agent) to repost fan‑submitted content to the creator's connected social accounts. You represent that you own or have the rights to the content you submit and that it does not violate any law or third‑party right.
6. Acceptable use
Don't misuse the Service. You agree not to: violate law or third‑party rights; upload unlawful, infringing, harassing, hateful, or sexually exploitative content; impersonate others; spam or manipulate metrics; attempt to access accounts, tokens, or data you're not authorized to; or interfere with the Service's operation or security.
7. Purchases & payments
Purchases are processed by Apple, Google, and/or Stripe under their terms. Prices are shown before purchase. Except where required by law or stated at the point of purchase, sales are final and non‑refundable; some perks depend on real‑world events and are not guaranteed. You authorize the applicable processor to charge your selected payment method.
8. Third‑party platforms
The Service integrates with third parties (including Instagram/Meta, TikTok, Apple, Stripe, Cloudflare, Neon, and Mapbox). Your use of those services is subject to their terms. DayOne is not affiliated with, endorsed by, or sponsored by Meta or TikTok.
9. Intellectual property
The Service, including its software, design, and trademarks, is owned by DayOne or its licensors and protected by law. We grant you a limited, revocable, non‑transferable license to use the Service for its intended purpose.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. Provisions that by their nature should survive (e.g., licenses you granted, disclaimers, limitations, and indemnity) survive termination.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE, OR THAT ANY OUTCOME (E.G., REACH, ENGAGEMENT, OR INCOME) WILL BE ACHIEVED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100.
13. Indemnification
You agree to indemnify and hold DayOne harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or any law or third‑party right.
14. Governing law
These Terms are governed by the laws of the United States and the state in which the operator of DayOne is established, without regard to conflict‑of‑laws rules. To the extent permitted by law, disputes will be resolved in the courts located there.
15. Changes
We may update these Terms. We'll post the updated version here and revise the "effective" date; continued use after changes means you accept them.
